- In this notice, whenever you see the words 'we', 'us', 'our', gya, 'gya labs' all refers to Gya Labs
- These Terms of Trade apply to any purchase of any Products by you from this website which are delivered in the United States, UK or internationally.
We aim to deliver “products” to you at the place of delivery requested by you within the time indicated by us at the time of your order, but we can’t guarantee firm delivery dates or times. Once your order has been accepted, Gya Labs will process your order by packing and arranging for delivery of the goods to you.
Your order will be delivered around 7 business days after it leaves our warehouse. However, depending on your location, it may take up to 15 business days to arrive at your address of choice. Please ensure that the shipping address provided to us at checkout is correct.
We accept no responsibility for deliveries to incorrect or incomplete addresses provided by customers. If you provide an incorrect address and delivery is completed, you will be responsible for the purchase. If you provide an incorrect address and delivery is not completed, the order will be returned to us and you will be responsible for any charges incurred in re-delivering the goods to the correct address.
Risk and title in goods purchased from the Company will pass to you upon delivery of the goods at your nominated delivery address. We accept no responsibility for damage caused to goods after delivery.

1. To submit an order for Products (Order), you must:

They must not be resold in any form or any place; Gya Labs reserves the
right to take legal action against unauthorised and unofficial sale of
goods.

1. All prices on the website are in US dollars and do not include
applicable sales taxes. The total cost including any applicable taxes
will be displayed during check-out, once you have selected your billing
and shipping address. Prices are subject to change without notice.
2. The amount payable to Gya Labs for an Order (Order Amount) will be the total of the following amounts:
- a. the sum of the price of each Product ordered as indicated on
the website at the time of submitting the Order (Product Subtotal); - b. the cost of delivery determined in accordance with Delivery stated above, and
- c. the sum of any other fees which Gya Labs levies from time to
time and which you have agreed to pay by providing your electronic
consent (e.g. subscription fees).
3. You must pay the Order Amount by credit card at the time of
submitting the Order. Gya Labs accepts Visa, Mastercard, American
Express, Google Pay, PayPal or Shop Pay.
1. Without limiting Gya Labs's legal rights arising from any
failure by you to make a payment in accordance with these Terms of
Trade, Gya Labs reserves the right, in its absolute discretion, to take
any of the following actions against you if you fail to make such a
payment:
- a. withhold supply and dispose of the Products requested in the Order, and/or
- b. refuse to deal further with you,
- c. and Gya Labs will not be liable to you for any loss or damage directly or indirectly resulting from any such action.
2. The Products sold and or information is rendered to you on the
understanding that you have sole responsibility for determining the
suitability of the Products and its use cases and agree to not hold Gya
Labs liable for any damage, injury or claims. You solemnly agree to
surrender any such disputes if any, to be resolved as per to the laws
and courts of Hong Kong SAR.
3. Subject to the following "No Warranty" clauses and to the
fullest extent permitted by law, the liability of Gya Labs for any loss
suffered by you as a result of Gya Labs breaching its obligations under
these Terms of Trade or other tortious duty (including arising by reason
of defects in the Products) is limited to a refund or replacement of
the relevant Products.
- Subject to the fullest extent permitted by law, Gya Labs gives no warranty in respect of the Products.
- For consumers the Products come with non-excludable warranties
and guarantees under consumer protection legislation as per Hong Kong
SAR, such as that -
Gya Labs is the rightful owner,
the Products are reasonably fit for their usual purpose,
are of acceptable quality, and
match any description or sample.
- If Gya Labs breaches any of these non-excludable warranties or
guarantees, you are entitled, at your option, to a refund or replacement
of the relevant Products.
- If you receive a product different from what you ordered, you
have the option of exchanging or refunding it. Only items purchased on
the Gya Labs website can be returned to Gya Labs.com for refund or
exchange. - Please note that for any cases of returns, we require a Return
Authorization Number. Return acceptance is at the sole discretion of Gya
Labs as we endeavour to offer a fair return policy in all cases. To
receive a Return Authorization Number, please reach us at info@gyalabs.com. - If you are returning an item(s), please ensure to include all
parts and pieces including printed materials in order to be eligible for
the refund and to ensure that your returns are received by Gya Labs. - The customer is responsible for the shipping costs incurred when
sending the items back to Gya Labs. If you received a damaged product,
Gya Labs will provide you with a full refund or exchange. Return postage
will be reimbursed in case of damaged, defective or incorrectly sent
items and a reimbursement will be issued in the original form of
payment. - Please retain your postal receipt from the shipping carrier
until you are certain your parcel has been safely received by Gya Labs.
We may need to verify it if we fail to receive your package. - We will do our best to process returns within 5-10 business days
of receipt and a reimbursement will be issued in the original form of
payment.
Where Gya Labs makes a Taxable Supply to you under or in connection with
these Terms of Trade or in connection with any matter or thing
occurring under these Terms of Trade and the consideration otherwise
payable for the Taxable Supply does not include Sales Tax, Gya Labs will
be entitled, in addition to any other consideration recoverable in
respect of the Taxable Supply, to recover from you the amount of any
Sales Tax on the Taxable Supply.
- The provision of terms & conditions fall under the
jurisdiction of Hong Kong SAR and if any party needs to raise dispute
for whatsoever reasons on Gyalabs.com, this will follow rules &
regulations governed by Hong Kong SAR and settled by the courts of Hong
Kong SAR. - The Terms of Trade, together with the Order (as accepted by Gya
Labs), the Legal Notice on the website and Gya Labs's Privacy Policy
constitute the whole agreement between the parties, and supersede all
prior discussions and agreements between them. - Orders and these Terms of Trade will be governed by the law
applying in the Hong Kong SAR, and the parties irrevocably submit to the
non-exclusive jurisdiction of the courts of Hong Kong SAR, and the
courts complement to determine appeals from those courts, with respect
to any proceedings that may be brought at any time in relation to these
Terms of Trade. - The products listed on Gya Labs are not intended to cure,
diagnose or treat any medical conditions. Usage of information, products
& services on our website is done at your own risk. You comply that
the use of information and products provided on this site is given
without any liability (incl. damage, injury or claims) on the part of
Gya Labs. - The views expressed in Gya Labs have not been evaluated,
endorsed or authorized by any other private, public or government
entity. Under no circumstances must the information on Gya Labs be
substituted for the advice provided by your physician or other health
care professionals.
